You agree to indemnify, defend, and hold harmless Digital Mafia, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our Website and services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
10. Refund Policy.
Digital Mafia maintains a strict "no refunds" policy. By accepting these terms, you acknowledge and agree that all payments made to Digital Mafia or any of its subsidiaries (Liveninja.ai, Gramify.io, AI Workflows, etc.) for digital marketing services, including but not limited to social media management, search engine optimization, pay-per-click advertising, content creation, ai/crm automation, consulting, and other related services are final and non-refundable.
11. 100% Moneyback Guarantee (AI Workflows). In the event that a money back guarantee has been offered (in writing and/or on invoice) the user must adhere to terms, not limited to: Using at least (9) bots and posting results, completing at least (2) Masterclasses and posting feedback, attending at least (2) virtual meetings. Then and only then may the Company reimburse the customer, at its own discretion.
12. Cancellation.
Unless expressly stated otherwise, products and services must be cancelled in writing and at least 30 days prior to automatic renewal dates. Any days thereafter will be charged at a prorated rate.
13. Termination
We may terminate or suspend your access to our Website and services, at our sole discretion, without notice or liability, for any reason or no reason, including, without limitation, your breach of these Terms. Upon termination, your right to use the Website and services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Digital Mafia is located, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in the same jurisdiction as Digital Mafia for the resolution of any disputes arising out of or relating to these Terms or your use of the Website and services.
15. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
16. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
17. Entire Agreement
These Terms and any additional terms, conditions, and policies referenced herein or available by hyperlink constitute the entire agreement between you and Digital Mafia regarding our Website and services and supersede all prior agreements, understandings, and communications, whether written or oral.
